Don’t Kill The Vibe — Terms of Use

These terms are an agreement between you and Don’t Kill The Vibe LLC (“DKTV”, “we”), 2025 Cedars Hill Rd, Lansdale, PA 19446-5897, USA, for the Don’t Kill The Vibe app and related services (“the app”). By using the app you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the app.

1. YouTube

DKTV uses YouTube API Services to search for and play music. By using DKTV you also agree to be bound by the YouTube Terms of Service. Videos are played in YouTube’s own player and remain YouTube’s and their owners’ content; DKTV doesn’t host or own them. Google’s handling of information is covered by the Google Privacy Policy.

2. Who can use DKTV

• You must be at least 13 to use the app. If you are under 18, you need a parent or guardian’s permission, and they agree to these terms for you.
• Some features are for adults only (for example, video reactions and, when hosting, allowing explicit songs).
• Don’t use DKTV if you are barred from doing so under the laws that apply to you.

3. Your account

• The app creates an account for you automatically. You can add an email address, mobile number, or an Apple or Google sign-in so you can get back to it.
• Keep your sign-in methods secure. You’re responsible for what happens on your account.
• You can delete your account at any time in Profile → Account & security.

4. Playing

• DKTV is a party game. The host’s phone plays the music for the room, and everyone else plays on their own phone. Players who aren’t in the room can join remotely and hear the music on their own phone.
• Private, personal use only. DKTV is for home parties and private gatherings. Don’t use it to play music for the public or at a business (such as a bar, venue or event you charge for) without the music licences that use requires.
• The host is responsible for the party they run, including which songs are allowed and who is in the room.

5. What you post

“Your content” means anything you put into DKTV that others can see: names and aliases, profile photos, chat messages, song picks and video reactions.

• You keep ownership of your content. You give DKTV a worldwide, non-exclusive, royalty-free licence to store, copy, display and send your content only to run the app (for example, to show your alias to your party, keep your nights in My Nights, and review reports). This licence ends when your content is deleted, except where we keep it to handle a report or as the law requires.
• You must have the right to post what you post. Don’t post other people’s photos or videos of them without their permission.
• Video reactions (up to 30 seconds, with sound) are seen only by the players in that party, and deleted automatically after a short period (see the Privacy Policy).

6. Rules: zero tolerance for abuse

DKTV has no tolerance for objectionable content or abusive users. Don’t:

• harass, bully, threaten or intimidate anyone;
• post hate speech, or content attacking people for who they are;
• post sexual content, nudity, or anything sexualising a minor;
• post violent, graphic or illegal content, or encourage self-harm;
• impersonate someone, or post someone’s private information;
• spam, cheat, interfere with other players’ games, or try to break, overload or reverse-engineer the app;
• use DKTV to break the law, or YouTube’s or Apple’s rules.

How we enforce it. The app filters offensive words, and you can report or block any player, message or reaction by pressing and holding it. We review reports promptly (aiming for within 24 hours) and may remove content, remove a player from a party, or suspend or close accounts, with or without notice. Blocking is private: the person isn’t told.

7. Our content

The app, its name, logo, design, game and software belong to DKTV or our licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose under these terms. Music and videos belong to their owners and are provided through YouTube.

8. Purchases

• Hosting needs an account. Joining a party is free and needs no account. A new host's first party is free for up to an hour; after that, the host pays for play time with tokens (currently 1 token per 30 minutes) or the optional Unlimited subscription. Guests never pay to play.
• Tokens and Unlimited are bought through the App Store or Google Play and charged by Apple or Google under their terms. Prices are shown in the app in your currency before you buy.
• Tokens can also buy optional extras in a party: more time to pick, a second chance, an Encore or Play Next. Encores and Play Next songs are bonus songs and score no points. Nothing you buy changes how votes or points work. If a party ends before a paid Encore or Play Next plays, the token is returned to you.
• Tokens have no cash value, can't be exchanged for money or transferred, and are licensed, not sold. Purchased tokens don't expire, but they are lost if you delete your account.
• Unlimited renews automatically every month until you cancel in your App Store or Google Play account settings, at least 24 hours before the renewal date. Refunds are handled by Apple or Google under their policies.
• You can restore your subscription on a new phone from the app (Get Tokens → Restore purchases).

9. Changes and availability

We’re improving DKTV all the time, so features may change or stop. We may update these terms; if a change is significant we’ll tell you in the app before it takes effect. Continuing to use DKTV after that means you accept the new terms.

10. Ending

You can stop using DKTV and delete your account at any time. We may suspend or end your access if you break these terms or if we have to for legal reasons. Sections 5 (licence for reviewing reports), 7, 11, 12 and 14 survive.

11. Disclaimers

DKTV is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that the app will be uninterrupted, error-free, or that any particular song will be available. We aren’t responsible for content posted by other players or for YouTube’s service.

12. Limit of liability

To the extent the law allows, DKTV won’t be liable for indirect, incidental, special, consequential or punitive damages, or lost data or profits, and our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don’t allow these limits, so they may not apply to you.

13. Apple

If you got DKTV from the Apple App Store:

• These terms are between you and DKTV only, not Apple. Apple isn’t responsible for the app or its content.
• Your licence is limited to using the app on Apple devices you own or control, as allowed by the App Store’s Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the extent the law allows, Apple has no other warranty obligation.
• DKTV, not Apple, is responsible for handling any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, and consumer protection claims.
• DKTV, not Apple, is responsible for investigating and defending any claim that the app infringes someone’s intellectual property.
• You confirm you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts serving Montgomery County, Pennsylvania. Nothing here limits rights you have under the consumer laws where you live.
